In the February 15, 1987 “Biomedical Safety & Standards Magazine”- Volume 17, Number 4 on page 28 an article appears entitled: “Lawsuit filed in wake of Oxygen shut-off at Denver Hospital”

Synopsis: Lawsuit filed in wake of Oxygen shut-off at Denver Hospital

A lawsuit has been brought against Denver’s Children’s Hospital, said to be the first such action following a November 29, 1986, accidental shut-off of the hospital’s main oxygen valve. Claiming that her daughter Chelsea suffered injury because of the shut-off, Teri Harper of Cheyenne, WY filed the suit in Denver District Court. Police had established that the oxygen valve was accidentally turned off by a hospital housekeeper employee who had access to the linen room where the valve was located. The employee reportedly turned off the valve because he thought it was a radiator control and the room was too hot. No criminal charges were filed.

The shut-off left 19 seriously ill babies without supplemental oxygen for about two minutes, according to the hospital. At no time were the babies without room air. Two babies died within days of the shut-off, but the Denver District Attorney’s office told this newsletter that there was no evidence their deaths were related to the oxygen turn-off. The lawsuit alleges that the hospital had a duty to make sure the oxygen valve couldn’t be intentionally or inadvertently turned off.
